    Current Position

In December 2021, the Malaysia Plastic Sustainability Roadmap, 2021–2030 (hereinafter “the Roadmap”) was published in Malaysia. The Roadmap identifies strategies and concrete action plans for achieving plastic circularity within the country.

The Roadmap presents the concept and mechanism of a circular economy and analyzes the current state of policy measures, regulations, technologies, R&D, and economics with regard to the entire life cycle of plastics from production to disposal, outlining responding action plans.

This road map is intended to serve as a set of guidelines for all relevant stakeholders in ensuring sustainability throughout the plastic value chain, with the end goal being the creation of new value that is beneficial to society and the environment.

Three objectives for controlling plastics as set out in the Roadmap are:

    • To sustainably address plastic pollution in Malaysia, ensuring economic development, environmental protection and societal wellbeing;
    • To provide guidance and promote sustainable business practices in ensuring plastics circularity and sustainability through circular economy approach; and
    • To harmonise actions along plastic value chain through adoption of life cycle approach.

Following this road map, the government’s objective is to maximise the percentage of plastic collected for recycling to 40% by 2025.

Tax deductions under Section 34(6)(h) of the Income Tax Act 1967 can be given to any relevant person who carries out community projects that provide significant benefits to the public in Malaysia related to the fields of education, health, housing, infrastructure, information and communication technology or maintenance of a building designated as a heritage site, projects to increase the income of the poor as well as environmental preservation/conservation projects.

    Approval requirements include:

    1. projects benefiting only the public in Malaysia without having any interest in contributors; and
    2. projects that are voluntarily contributed and are not required by the authorities under any regulation.

    Proposal

To support the recycling of plastic waste as an economic resource and to ensure the collected-for-recycling rate can be increased through a more effective and organised plastic waste collection programme, it is proposed that tax deduction under Section 34(6)(h) of the Income Tax Act 1967 be given to companies and other than companies (individuals, partnerships, trusts and cooperatives that have business income) that make donations or sponsorships of Artificial Intelligence (AI) – Driven Reverse Vending Machine.

    Effective Date

  • Tax Incentive for Company Renting Non-Commercial Electric Vehicle

Tax Incentive for Company Renting Non-Commercial Electric Vehicle

Updated on 15 July 2023- Dialogue between MOF, LHDNM, and CTIM [21/6/2023]

Update: The Ismail Sabri Government Budget is no longer applicable. Malaysia’s national budget for 2023 was re-tabled again in February 2023.

To Download Revised Budget 2023 Speech and some other related publications – https://www.ccs-co.com/post/budget-2023-malaysia-madani

    Current Position

Companies renting non-commercial motor vehicles, including Electric Vehicles (EV), are given tax deductions under Section 39(1)(k), Income Tax Act 1967, as follows:

    1. cost of the vehicle not exceeding RM150,000, the maximum rental amount allowed for tax deduction is limited up to RM100,000; and
    2. cost of the vehicle exceeding RM150,000, the maximum rental amount allowed for tax deduction is limited to RM50,000.

The tax treatment is effective from the year of assessment 2002.

    Proposal

The maximum rental amount for electric vehicles that can be deducted for tax purposes is proposed to be capped at RM300,000 to incentivise the use of low-carbon automobiles.

    Effective Date

From the year of assessment 2023 until the year of assessment 2025.

Updated on 15 July 2023- Dialogue between MOF, LHDNM, and CTIM [21/6/2023]

Currently, the capital allowance (“CA”) treatment for a non-commercial electric vehicle (“EV”) is provided under Para 2(2) of Sch 3 of the ITA 1967.

Similar to the above proposed RM300,000 limit for a tax deduction on rental, CTIM suggested that the limit for qualifying plant expenditure incurred on a non-commercial EV should be increased to RM300,000 in a corresponding PU Order on capital allowance to encourage usage of low-carbon vehicles and for neutral tax treatment on leased vehicles and purchased vehicles.

    MOF’s Feedback:

This proposal has been duly noted.

However, MOF will conduct further studies on the impact of the proposal.

CTIM appreciated the Government’s policy to have incentives for short periods, but three years appears too short when adopting non-commercial EVs. It is recommended to have a longer window to provide more certainty for taxpayers who are considering this option.

    MOF’s Feedback:

This proposal has been duly noted.

Introducing a 3-year leasing period is intended to assess companies’ acceptance and utilisation of green mobility.

By doing so, it will provide the government with the opportunity to review this initiative and make interventions/improvements if necessary.

CTIM sought confirmation on the above effective date means that the first rental for the noncommercial EV must be during the period from YA 2023 to YA 2025, and the tax deduction for the entire RM300,000 amount does not necessarily need to be claimed during this period.

For example, if the non-commercial EV is rented in 2025 and the company continues to pay for that same vehicle up to 2027, then the company can claim the tax deduction on the rental up to 2027 as long as the RM300,000 cap is not breached.

This same principle should apply to the CA CTIM asked for above as long as the non-commercial EV is purchased from YA 2023 to YA 2025.

    MOF’s Feedback:

Details of tax treatments are being finalised.

Appendix 14 states “proposed company”. CTIM suggested that it should apply to any person carrying on a business.

Response from LHDNM (Inland Revenue Board):

The eligible companies for this incentive are companies as interpreted under Section 2 of the ITA 1967.

  • Review of Tax Incentive for Equity Crowdfunding

Review of Tax Incentive for Equity Crowdfunding

Update: The Ismail Sabri Government Budget is no longer applicable.

Malaysia’s national budget for 2023 was re-tabled again in February 2023; for more info, please visit – https://www.ccs-co.com/post/budget-2023-malaysia-madani.

This tax incentive included in Budget 2023, tabled in Parliament on 7 October 2022, was not included in Budget 2023 (Re-tabled) on 24 February 2023.

Response from MOF: MOF is currently reviewing off-budget items.

The phrase “MOF is currently reviewing off-budget items” typically refers to the Ministry of Finance (MOF) evaluating or examining expenses or financial matters that are not included in the official budget. Off-budget items are expenditures or revenue sources not directly accounted for in the regular budgeting process.

Governments often create budgets to allocate funds for various programs, projects, and expenses. However, certain financial activities may fall outside the scope of the official budget. These off-budget items could include emergency spending, special funds, grants, subsidies, or other financial transactions not explicitly accounted for in the regular budgeting process.

When the MOF reviews off-budget items, they are scrutinising these financial activities to assess their impact, legality, appropriateness, or potential risks. This review aims to ensure transparency, fiscal responsibility, and effective financial management within the government. It helps identify discrepancies, assess the necessity and effectiveness of off-budget items, and make informed decisions regarding their continuation or modification.

    Current Position

Under the Order, 50% of the amount invested for each year of assessment will be deductible against the individual’s aggregate income, subject to the conditions as follows:

    1. the eligible amount for tax exemption is limited to RM50,000 each year of assessment;
    2. the deductible amount is limited to 10% of the aggregate income for that year of assessment. The excess amount will be disregarded;

Proposal [This tax incentive included in Budget 2023, tabled in Parliament on 7 October 2022, was not included in Budget 2023 (Re-tabled) on 24 February 2023]

To attract more individual investors to invest in start-up companies through equity crowdfunding, it is proposed tax incentives be reviewed as follows:

    • scope of tax incentives be expanded to include investments made by individuals investor through Limited Liability Partnership Nominee Company; and

  • Sustainable and Responsible Investment linked (‘SRI-linked’) Sukuk Framework

Sustainable and Responsible Investment linked (‘SRI-linked’) Sukuk Framework

The Securities Commission of Malaysia (SC) established the Framework for Sustainable and Responsible Investment-Linked Sukuk (the Framework) on June 30, 2022.

The Sustainable and Responsible Investment Sukuk framework was first introduced by the Securities Commission Malaysia (SC) in 2014. This was done to facilitate the creation of an ecosystem that promotes sustainable and responsible investing for SRI investors and issuers. The Framework was introduced in 2014.

The Disclosure Framework has been designed under international standards and best practices, both of which emphasise the significance of transparency concerning disclosure requirements.

This document is intended to serve as a reference for the relevant stakeholders. It should be read in conjunction with the other requirements outlined in the Guidelines on Unlisted Capital Market Products under the Lodge and Launch Framework and the Guidelines on Issuance of Corporate Bonds and Sukuk to Retail Investors, whichever of those two sets of guidelines is applicable.

    What is SRI Sukuk?

SRI Sukuk is where the Sukuk proceeds will be applied exclusively for funding any activities or transactions relating to the eligible SRI projects.

    Incentives and Grant Scheme

Tax Deduction on SRI Sukuk Issuances

    • Tax deduction for the expenditure incurred on the issuance of Sukuk approved or authorised by or lodged with the SC until the year of assessment 2023.
    • 90% of the proceeds raised are solely used to fund SRI projects as specified in the Guidelines by the SC.

Green SRI Sukuk Grant Scheme (the Grant)

From January 2018 until fully utilised:

    • The Issuer can claim for the Grant based on an issue or programme.
    • Should there be more than one issuance requiring a separate external review, the issuer can claim on that review cost incurred.

The application form is available at the Capital Markets Malaysia website – www.capitalmarketsmalaysia.com

The Grant will be paid on a reimbursement basis within 60 days upon complete submission.

Sustainable and Responsible Investment-Linked (SRI-linked) Sukuk Framework

The following guidelines have been updated, including the introduction of a new chapter on the framework as well as the setting out of the additional requirements concerning the issue of SRI-linked Sukuk:

    • Guidelines on Unlisted Capital Market Products under the Lodge and Launch Framework.
    • Guidelines on Issuance of Corporate Bonds and Sukuk to Retail Investors.

The framework is an extension of the efforts that were announced in 2019 as part of the SRI roadmap to increase the range of SRI products that are available.

More importantly, this effort represents the SC’s determination to broaden the scope of the Islamic Capital Market (ICM) to include a broader range of economic stakeholders and to construct an ICM ecosystem conducive to advancing the sustainability agenda.

You can access a list of frequently asked questions that the SC has released about the SRI-linked Framework here.

The convergence of the physical, digital, and biological worlds are referred to as the “Fourth Industrial Revolution,” and it is a term that has been used to describe this phenomenon.

It is a combination of recent developments in Artificial Intelligence (AI), robots, the Internet of Things (IoT), machine to machine (M2M), genetic engineering, quantum computing, and other technology areas. It is the conglomerate force underlying many different products and services that are rapidly becoming essential to modernity.

Think of GPS systems that suggest the quickest route to a destination, voice-activated virtual assistants such as Apple’s Siri, personalised Netflix recommendations, and Facebook’s ability to recognise your face and tag you in a photo taken by a friend.

All of these technologies are examples of the advancements in artificial intelligence that are currently available.
